Topic:

“Shifting the Risk: Transitioning from Cost-Reimbursable to Lump Sum Contracting”  

Cost-reimbursable contracts appear to be losing their foothold in the large-scale EPC contracting arena as more and more project owners move to lump sum pricing. While it may seem that lump sum contracts shift much of the risk for schedule and cost back to the contractor, there are hidden risks for all stakeholders. This interactive panel will encourage a dialogue between owners and contractors as we explore best practices for managing projects in a lump sum versus cost-reimbursable environment. Participants will gain tools and strategies to assess the shift in risk when transitioning from cost-reimbursable to lump sum contracts, understand key differences in administering changes under a lump sum versus reimbursable contract, and address the “cost-reimbursable mindset” that may hinder success on lump sum projects.

Speakers:

Louise Blake, Director, Commercial Risk, KBR 

Louise Blake has 25 years of experience working for global contractors in the onshore and offshore EPC and maintenance and operations fields. Her project lifecycle execution experience includes bid development and negotiation, project management, subcontracts and supply chain management, and contracts and commercial management. She focuses on the development and implementation of commercial strategies, processes and procedures, commercial risks evaluation and mitigation, commercial model development and implementation, and contract terms negotiations through to final account, including management of claims.

 

Shelley Eichenlaub, Senior Legal Counsel, Motiva Enterprises LLC 

Shelley Eichenlaub is Senior Legal Counsel for Major Projects at Motiva Enterprises, LLC.  In her role she is currently providing legal guidance for several chemical expansion projects being considered by Motiva and sits on the Major Projects Leadership Team.  Prior to joining Motiva, Shelley was Senior Legal Counsel for Anadarko where she provided legal advice and managed contract drafting and negotiations for the Mozambique LNG Project, a world-scale, integrated LNG megaproject.  Prior to Anadarko, Shelley worked at Sasol, serving on the U.S. Megaprojects team as lead lawyer for a suite of engineering, construction, and procurement contracts for the Lake Charles Chemical Project, a world-scale ethane cracker and derivatives complex. Shelley began her legal career at KBR, providing practical legal guidance on numerous international and domestic project transactions from planning to execution.

 

Shawn C. Modar, P.E., Vice President, The Rhodes Group 

Shawn Modar is Vice President of The Rhodes Group, an international construction consulting firm with offices in Pittsburgh and Houston. Shawn has 19 years of experience in the engineering and construction industry with the majority of that time being focused on construction claim analysis and dispute resolution. Shawn draws on his experience in the areas of claim analysis and dispute resolution to assist EPC contractors, subcontractors and owners throughout the project lifecycle. His primary focus is assisting his clients in their efforts to substantiate or defend against claims for the recovery of time and additional costs, avoid formal disputes and make informed decisions that result in equitable resolutions.

Detailed campus maps are available on the web at http://www.rice.edu/maps/. The Ley Student Center is located in the central part of Rice campus. The Central Campus Garage, which is the closest parking facility, is located to the across the street from the Student Center.

In the possibility the underground parking is full, the second closest parking is the West Lot. Continue down the Laboratory Loop Road to the stop sign. The campus also offers a bus shuttle that runs about every 15 minutes as it loops the campus.
